HIV and African Americans Essay - 1578 Words
The term Human Immunodeficiency Virus is commonly known as (HIV), which is a virus that attacks the immune system of humans by destroying the amount of CD4 cells in their bodies. Without CD4 the human body is unable to fight against diseases, which can lead to Acquired Immune deficiency syndrome known as AIDS for short. The first case of the HIV/AIDS virus in the U.S. occurred in the early 1980ââ¬â¢s. The first spark of the virus was found in San Francisco with couple of homosexual Caucasian American males. Today African Americans account for the largest proportion of HIV and AIDS in this country, represent approximately 13% of the U.S. population, but accounted for an estimated 44% of new HIV infections in 2010(the last year a study wasâ⬠¦show more contentâ⬠¦This can only happen if we stop pointing fingers at African American for the massive spread of the virus. And also stop pointing finger at black homosexuals for the strikingly large percentage of the HIV infection. W e must put an end to the stigma that HIV only carries with African Americans. Years ago Yale University law professor Harlon Dalton said this about HIV/AIDS, ââ¬Å"We cannot approach the AIDS problem in a color blind fashionâ⬠(Priest). With this being said we need to stop pointing fingers at blacksââ¬â¢ for the disproportionate factor of HIV in this country. And also stop pointing fingers at black homosexuals. To be honest HIV/Aids is not a virus/disease that aim towards blacks although a large percentage of the African American population is carriers of the virus. Privacy has truly lost its value. The advance of technology leaves nothing unturned. Electronic devices is the main source of violating privacy such as social media. Social media has made it easy to advertise our personal information for the world to see which may hinders our interaction with society. Question: Discuss about the Corporate law and Capital Maintenance. Answer: Creditors of a company provide it with key resources to continue its business operations. However they are subjected to various risks as the main control of the companys affairs are in the hands of the directors (Simes 2013). The directs of a company in order to gain maximum personal interest may at any time buy back the shares of the company which will leave the creditors with nothing as the company is a separate legal entity. The overall objective of the doctrine of capital maintenance is to protect the creditors of the company which they may be subjected to because of the actions of the directors. The doctrine has first been brought to the lime light in England from the case of Trevor v Whitworth(1887) where the court imposed restriction on a company from buying its own shares. According to the doctrine of capital maintenance it is the duty of the directors to obtain the the total amount of consideration for the shares the company has issued. The directors of the company are furth er restricted from making any repayment to the shareholders with respect to the amount paid by them except is very rare and limited circumstances. With respect to such provisions the doctrine provides rules and regulations in relation to the payment of dividends, using financial assistance and share repayment or buyback. Like most of the common wealth countries Australia has also incorporated the concept provided by the doctrine into its corporation law. The concept relating to this doctrine has been brought into the corporation law of Australia through the Corporations Act 2001. However its incorporation was often subjected to debates. The critics of the doctrine provide that the doctrine has a very restrictive approach which hampers and hinders the proper functioning and growth of a registered corporation (Bradbury 2015). If the company is deprived of the liberty of share buy backs and reduction of capital than it would evidently make it suffer losses at the time when the market is down. Keeping this aspect of the doctrine in mind the Australia law makers have provided the doctrine with a liberal approach through the various sections of the corporations act (Hannigan 2015.) Section 257 A of the Corporation Act enables the directors of a company to buy back its shares only if such buyback does not in any was affect the position of the company to make repayments to its creditors. The Section further provides that the company has to abide by the procedures in relation to share buyback which have been incorporated into the Act through section 257 D. The company has to pass a special resolution at its general meeting. The resolution has to be passed without giving any voting rights to the share holders whose shares are to be bought back. All documents in relation to the offer of buy back proposed by the company have to be registered with the AISC before such buy back is continued (Hendricks and Blackwood 2014). Thus it can be analyzed through these Sections in relation to share buyback and capital reduction that the Australian corporation law has made best effort to ignore the ill effects of the doctrine and only incorporated the concept of providing protection to creditors within it. Is this why the Senate has more power than the House of Representatives? I would contend that the two chambers are equal. Not that they have the same powers, but equal in that neither the Senate nor the House can make a law without the other. Under the U. S. Constitution, the two chambers are equal, however; the Constitution gives certain exclusive powers to each chamber. For an example the Senate has powers to confirm Presidential nominees that they do not share with the House, and the House has powers to originate all tax/spending bills that are not shared with the Senate (Nickels n. d. ). Dye and Zeiglerââ¬â¢s Elite Theory claims that representative democracy is not really based on the will of the people, but a small elite class that governs the masses. ââ¬Å"Only one branch of the new government, the House of Representatives, was to be elected by popular vote. The other three controlling bodies-the president, the Senate, and the Supreme Courtââ¬âwere removed from direct voter participationâ⬠(2009). According to Dye and Zeigler none of the delegates showed any enthusiasm for mass participation in democracy.

Motivation In A Business Start Up Business Essay There are misconceptions on the meaning of motivation and the ways in which it influences organisations if at all. Motivation can be seen as the drive an individual has to achieve a set goal; however Laurie J. Mullins (2005) describes motivation as the direction and persistence of action. There has been a wide range of research concerning the topic of motivation; however there are still arguments on the extent to which it has an influence on existing businesses and if so how these businesses can use it to their advantage. I am quite intrigued by the idea of motivation, as my main aim at present is to become a Financial Manager. As a result of this main aim I have decided to broaden the ideas I have about individuals thinking and the factors that increase their performance during the course of this assignment for future use. Research and Observation Using books and online case studies I have found that it could be argued that motivation is quite a broad topic as there are many aspects to it; however I find that motivation is as simple as an individuals desire to achieve. Business analysts like Mullins (2007:251) have identified that motivation is not only brought about by the individual but also by the environment in which they are working in. Laurie J Mullins (2005) seems to believe that performance = function (ability * motivation) which seems to suggest that an individuals motivation to achieve is a factor of their performance (for example how well they get the job done). This then brings about the main question, how essential is motivation in a business setup? How can motivation be practised in a given business set up? The Volvo case study (Robbins, Judge, Campbell 2010); Volvo being a car manufacturing business, its goal was to motivate its employees to produce these quality cars which would in turn maximise its profits. In order to motivate its employees it decided to practice the strategies of a self-managed team, where the team members were responsible for producing the cars and had a supervisor to report to if any problems were to occur. Volvo genuinely believed that this autonomy would motivate employees to would harder, however it all went pear shaped as it turned out that the meetings with supervisors were now get-togethers where the team members criticised each others performances to the supervisor. Having observed this strategy we find that this was not a form of motivation, as the individuals felt they had to work in order to reduce complaints about them to the team supervisors, not because they genuinely wanted to perform better. Many companies like Volvo set out to motivate their emplo yees in various ways (such as the self-managed team), but I believe that the business should then be aware and monitor their strategies to make sure they go according to their plans. The way I see it is that the situation with Volvo may be seen as an ethical issue as the employee stress could have resulted due to the fact that they always had to watch their backs when working (due to the fact that they may have felt that their jobs were not secure). This thereby demonstrates that businesses have identified that their employees need to be motivated in order to perform on the job. This self-management strategy turned out to be a great strategy for the business product line, but the real question is was this strategy an incentive? Linstead, Fullop and Lilly (2004) point out McKenna (1999: 301) states that the topic of motivation has lost its relevance and needs to be replaced with concepts such as sense making, identity and diversity. He seems to believe that motivation is brought about by the individual; organisation intervention suggests that the organisations are influencing or manipulating the situation as we have identified with the Volvo case study. McKenna (1999)s theory being quite an interesting observation one is able to visualise what he was trying to put across (Volvo case study), but does this then mean that motivation can only be brought about by the individual, with it being essential to businesses? There are other researchers such as Roy Jacques (1996:160-1) who believe that, there are categories of workers who do not need motivation, who are more career and professionally oriented. However observing ourselves we find that each individual, not looking at whether they are career oriented or not, has days when they feel down or times when they do not feel like performing. There then has to be an incentive to encourage them to carry out their daily routines, such money or the need to socialise which we know as motivation incentives. Having acknowledged this observation, if an individual needs motivation to carry out their daily routines then we are reluctant to believe that (all the more) they will need them in order to perform at a high standard for the business to achieve its goals. Marchese (2003) As identified above, there are quite a number of theories different researchers have come up with, which now shape the way in which many individuals perceive motivation. All the theories above, in one way or another are stating that individuals need to be motivated in order to perform, thereby implying that the more motivated an individual is the higher their performance level will be. One of the well-known theories of motivation being Abraham Maslows hierarchy of needs, Maslows theory argues that individuals have a hierarchy of needs, that motivation is attained by satisfying higher order needs, as identified below; Conclusion Siemens is an organisation that has based its motivational theories for employees on Maslows Hierarchy of needs. This was a result of the organisation acknowledging that not only do production levels increase when its employees are motivated but other factors too, such as the fact that employees who are motivated feel that their work is valued, which inspires them to take pride in the tasks they perform. Ultimately Siemens has identified that with as a set of demotivated staff; the organisation loses out on benefitting from factors that revolve around production maximisation. An example is that if staff do not feel valued (an incentive to motivation) then the organisation is more likely to suffer from staff absences or high staff turnover as no individual desires to be in an environment where they feel they are not required. This then brings the topic back to product/profit maximisation; the more absent the employees are the less the organisation will produce and the less profit the organisation will make. The higher the employee turnover (job satisfaction is low) a business has the more money it has to spend on recruitment which means the more the business loses money. This altogether brings down the level of efficiency the production level of the business is. Here we have only identified one aspect in which motivation increases performance, there are many more such as the fact that motivated individuals are more willing to work together as they feel they are all working towards the same goal, self-achievement. This is implying that the more employees feel that their needs are being met, the more they are willing to achieve the business needs, thereby stating that motivating employees in turn motivates the business. In his sonnets, poet and playwright William Shakespeare creates a romantic tone when describing how romantic relationships are affected over time. Vivian Tiller's article ââ¬Å"Is love really Blind? â⬠provides research to suggest that romantic relationships are affected over time because people tend to lose physical attraction to their mate. Consequences of Indecisionââ¬â¢s The characters are affected by their mistakes in Feed by M.T. Anderson because these characters are all caught up in their indecision to choose what they want to do with their lives. Violetââ¬â¢s father is all caught up in protecting his daughter, Violet the main character, from the negative affects of the feed and how people take advantage of it in a poor manner. He didnââ¬â¢t want that to happen to Violet. The Feed is a device that people in the novel use in their everyday lives. The Feed is a computer chip that gets installed into the brain allowing internet access where ever they are, exposing people to unlimited knowledge. This chip also allows them to have the internet as a part of them so it becomes a part of the brain thus making them all in some since, part robot. He never wanted to get Violet the Feed because he thought it would be terrible for her. He then realized that she needed it in order to have a productive future and live a decent life. The outcome of his delayed decision of installing the Feed caused negative affects on Violet. Violet has similar to her fatherââ¬â¢s thinking when it comes to the Feed. She canââ¬â¢t decide if she does or doesnââ¬â¢t want to be a part of society. She claims that she loves the Feed because of the knowledge that it has to offer. Violet wants the feed because she also yearns to be accepted into society. She then turns around and says that the Feed is a horrible thing because it separates people from the real world causing them to become unaware of whatââ¬â¢s really happening in the world. She also malfunctions in result of being hacked. This is the major issue that Violet and her father come across. Since these characters canââ¬â¢t choose what they actually want with society and the Feed only ends up leading them to their destruction. Violets fatherââ¬â¢s distraction with his thoughts is caused by his indecision on society with how people act. Many people would think that Violets father was doing the right thing by limiting his daughter to the technology, and they are wrong. If he was so against society then he should have left with Violets mother or just leave in general to get away. If they moved away and he never got her the Feed and she would have never gone to the moon. Apparently those thoughts never occurred to him. So he is living in a society that he strongly dislikes and refuses to become fully part of. Hisà problem with picking what he wants influenced him to get the Feed installed into her daughterââ¬â¢s brain late, because he realized that she would need it in order to live there and have a successful life. He realized this after he went to a job interview and he still didnââ¬â¢t have the Feed so he couldnââ¬â¢t get the job. This hesitation that he had was because he wanted his daughter to have real knowledge that you actually had in your head from memory and education. Not lazy artificial knowledge that she didnââ¬â¢t need to think to know something. He was being stubborn and thought he was doing something good for her. Many people would say that he just wanted to protect her. Well if he really wanted to protect her then why didnââ¬â¢t he just take her and leave that place? At the same time he wants to be around this great technology with its unlimited opportunities. Since he couldnââ¬â¢t choose a side that he wanted to be on he ran into issues because he cou ldnââ¬â¢t choose one or the other. Sadly Violet acts similar to her father. when it comes to Violet , itââ¬â¢s obvious that she is different from everyone else. She knows more then other people do because she had time to think and learn before she got the Feed, along with homeschooling. She has a larger vocabulary then the people that she lives around. Violet also doesnââ¬â¢t have as wide of a vocabulary as her father. She isnââ¬â¢t as intelligent as her father either. She is lonely to the point that she makes announcements into a trash can just to hear the echo of her own voice. She has no real close friends because of homeschooling, making her less exposed to other people in the world. Violet has similar indecisionââ¬â¢s as her father, being against the society and with it at the same time just doesnââ¬â¢t work. it has to be one or the other. If not then they will have plenty of issues, because when they go against the way how things function and try to change it only caused them problems that they have to pay for all on there own. Violets i ndividuality and intelligence made her get into problems because she wanted to see if she could trick the Feed to prove that technology canââ¬â¢t over power humans. As Violet goes to the mall to create another profile on her Feed it only backfires. She called this her project. Her project was to create an account that the Feed could not give options to for items that she may like. She tried creating this account by looking at random and odd things at the mallà that had nothing to do with each other, pretending to like them so that the Feed would think she takes an interest in them. This makes the Feed think that she would consider purchasing these items. Violets project backfired because she never bought anything that she made the Feed think she liked. The Feed was offering her these items, expecting her to buy some of them. When she never did apply to purchasing anything, Violet got hacked everything started to malfunction and her father couldnââ¬â¢t pay for the care and FeedTech had no interest in helping her because she wasnââ¬â¢t a good investment to society. No one from FeedTech or the inverters of FeedTech wanted to sponsor for her health needs because of her poor shopping records. These records stated, that she had looked up information on items and she didnââ¬â¢t purchase any of them. Violets project was a horrible idea because her father couldnââ¬â¢t afford to pay for all the tests that she needed. The warranty had also expired years ago. There is nothing that they can do for her now but wait as her father regrets not getting Violets Feed late. When Violet got hacked, it somehow damaged her Feed and no one was sure why. While she was in the hospital she was told by the doctors that her Feed should stabilize over time, it never did. Her Feed only progressed to worsen as time went on. Even when she was working on her project in the mall Violet didnââ¬â¢t consider how her actions would affect her . She knew that attempting to mess with the Feed wasnââ¬â¢t supposed to be done and that didnââ¬â¢t stop her . She went and did it anyway, her indecision to go against the Feed failed because she only got worse in the end. Her body slowly stopped working over time. In the beginning she was losing all feeling in her foot. Similar to having a foot fall asleep. Of course this turned into her whole limbs losing feeling. This resulted in her losing all feeling in both of her legs causing her to fall down the stairs when she was home alone. FeedTech didnââ¬â¢t want to help her because she made a record that stated how she doesnà ¢â¬â¢t buy anything that she takes interest in. All because she couldnââ¬â¢t make up her mind on what she wanted to do. She attempted to trick the Feed. Then she changed her mind when she was weak and tried getting help from FeedTech after she attempted to mess up the whole system. Since these characters canââ¬â¢t choose what they actually want with society. The Feed only ends up leading them to destruction. Violet and her father made so many mistakes that it came to the point where they couldnââ¬â¢t save her. They refused to cooperate with FeedTech so FeedTech wouldnââ¬â¢t pay for her repairs. When it came to her malfunctioning. They also refused to cover the cost because she messed up her Feed during her project at the mall when she was trying to trick the Feed so that it couldnââ¬â¢t predict or tell her what she would like. Since Violets father was so caught up in protecting his daughter he was protecting her to the point where his choices killed his daughter, destroying everything he has ever worked for because Violet is his life. Violet is all he has left because Violets mother ran away to Africa to escape the society that they claim to hate. When it turned out that them staying is a place that they dislike was all a mistake on itââ¬â¢s own. If they where going to stay they should have accepted the way things are. Violet and her father should have just given into the way of the Feed if they wanted to stay.

Stranger Monsters Professor Ramos Blog
Stranger Monsters Stranger Things is a rare breed of a series. It not only manages to capture itââ¬â¢s audiences attention with its incredibly unique story, but the actors are quick and easy to fall completely in love with. This series manages to have a fantastic character arc for the heroes as well as constantly having the threat of the unknown ââ¬Ëupside downââ¬â¢ constantly growing. While the first season focused on the demi-gorgon and the second on the demodogs, the third season brings a fresh villain which was teased at the end of the second season. The Mind Flayer has a unique approach on a monster which overall makes for a great and disturbing story. The show is set in the early eighties, which was a time where American citizens were afraid of the Soviet Union because of the Cold war. It was believed that there were secret Labs underground created by Soviet spies who would do human experimenting. This ended up being a major influence for this season. With the idea that they would eventually unearth themselves and start mind controlling people to fight against America. Mind Control was no laughing matter in the eighties. In fact, it was commonly feared by the majority of the american population. The term ââ¬Ëbrainwashingââ¬â¢ was actually born from the Cold war. It is said that, ââ¬Å"The notion of ââ¬Ëbrainwashingââ¬â¢ emerged out of the conjuncture in the outbreak of the Cold War and the sense of panic it created in American society. Efforts to master this panic found new intelligence infrastructure and in new frameworks of discourse, knowledge, and terminology.â⬠(Killen Andriopoulos 8) Basically, writers and filmmakers took advantage of the American knowledge, or lack thereof, and took advantage of it to produce novels and film. Killen Andriopoulos gave great modern examples of the Jason Bourne series and Shutter Island. (9) This ties in very well with Jeffery Cohens first monster theory, ââ¬Å"The Monsterââ¬â¢s Body Is a Cultural Body.â⬠(4) Although the eighties did not consist of a huge human consuming monster, the fear of Russian testing and the unknown was definitely real. Cohen states that, ââ¬Å"The monster is born only at this metaphoric crossroads, as an embodiment of a certain cultural moment.â⬠(Cohen 4) This monster acts as a representation of what Americans were afraid could happen or be created in the Cold war era. Having Allies turn against each other. The Mind Flayer throughout this season acts as a puppeteer, pulling the strings while having others it has assimilated do its bidding. What is interesting about this monster is that it also uses its ââ¬Ëhostsââ¬â¢ to grow itself, turning them into a slime like paste to which they crawl together to make the main monster bigger and stronger. Which works well in making a very uncomfortable scene watching a character go from a human to a semi-slime monster. But what exactly makes this monster scary? The Mind Flayer uses humans that it assimilates to do its bidding, which makes the human the villain. This is a very interesting metaphor in that the Mind Flayer, while it might not have necessarily been created by humans, is still in our dimension because of human curiosity and testing. The Mind Flayer, while it is its own monster, still came from the upside down. The fact of the matter is not that the monster has never left. The gate to the upside down was closed in one place but opened in another, never truly leaving the small city of Hawkins. Cohens second theory, ââ¬ËMonsters Always Escapesââ¬â¢ can be tied into the idea that while the group might have defeated the demi-gorgon and the demodogs in the previous seasons, the one thing that never left the city was the portal to the upside down. Acting as almost the main villain to the heroes, constantly throwing new monsters at them. The film Get out has a fantastic interpretation on mind control. Director Jordan Peele takes a unique twist on what is a simple horror movie and creates a monster that can control another human beings body, rendering them essentially a backseat driver in their own body. The idea of being conscious in what you are doing but not being able to do anything about it is truly a terrifying feeling. The characters are similar to the Mind Flayer in that when the highest bidder wins the body, the surgical procedure allows conscious to override and take control of the victims body. While the Mind Flayer does not have to have a surgical procedure to control its victims, it still overtakes the victim and has complete control over their actions and decisions. The Mind Flayer works so well as a monster because it is unique. While it has been done before the way it was presented and executed distracts the viewer and enthralls them into wanting more. This disgusting slimy beast works in the shadows which allows the actors to really shine. Also, some of the monsters actions create a real tear jerker for the viewer, giving major character development and allowing a fantastic story to play out through its ravenous destruction. There Is however one interesting fact about the monster that does leave some unanswered questions. In an interview with the directors and cast members for the third season, Matt Duffer stated, ââ¬Å"Eleven closed the Gate, but the Mind Flayer is still alive in the Upside Downâ⬠(Stack 2). Watching the season it is not really explained at all how the Mind Flayer managed to escape the upside down when the previous monsters did not. It is true that later in the season it is revealed that there is another gate being kept open by the Russian government. But this does not elaborate on how the Mind Flayer was the only thing able to escape after the gate was shut. Although there is a significant plot gap it does not take away from the overall story. The monster still provides a wonderful fresh experience and frightening demeanor for the viewers when on screen. But why does this creature work so well for this series? The Mind Flayer provides such a fresh, and creative idea of a monster that really strays away from the standard traditional horror films. And is a big reason why the series works so well. You are not expecting as a viewer to see some recurring characters just evaporate into a disgusting pile of goo and literally attach themselves together. But what has to be the most chilling trait of this monster is its ability to take over someones body and mind. The idea that your neighbor or family member could be actively trying to kill you adds a chilling on screen tension that definitely deserves more credit than what is given. This is a monster that is unique and different as opposed to your standard zombie. It has a mysterious background but a fantastic tool kit of skills it uses to terrorize the protagonists. This monster easily deserves a 4/5. While it does contain some miniscule flaws, the overall idea and execution of this monster were flawless. Its creativeness and uniqueness manages to leave the viewer constantly wondering what is next, or even who is next. Stranger things continues to display such unique and intriguing monsters that in the end, help create fantastic plot lines and seasons. And the third iteration of Stranger Things continues to live up to the expectations it has set in the first season. As we look at the act of terrorism that occurred on Tuesday, September 11, 2001 many feel the pain that is shared throughout the United States of America. They feel the frustration, agony, sorrow, and anger. This pain is shared mutually throughout the world even. Many of these people feel that we as a nation should strike back in full force, and aggressively tear down terrorism as a whole. In this short time since the tragedy there have been numerous polls taken that say America is ready to fight a long and drawn out war against terrorism. Perhaps war is not the answer. If we are to go to war will be stooping to the terrorists level. We will be killing thousands of people to make up the lives of the ones we lost, but that is not right, because you cannot bring back their lives now. We will be terrorists in their eyes. We will be coming in to their homeland, and taking away lives of people, because of their beliefs. They believe that their way is the right way, but so do we. We believe in freedoms, and we believe in having rights as people. An additional point is we will be sending many of our young troops to fight a battle that has already been won. We are a free nation and no act of terrorism should stop us from feeling free. There is nothing we can do to bring back the lives that have been lost. Going to battle is not going to win this war of freedom, because this war has already been won? For example, if a couple have had pervious issues with one person going behind anotherââ¬â¢s and speaking to their ex or person of opposite sex, then the thought of being easily connected with people through these sites can really build up the insecurity in the other persons mind and make them think that their partner is being unfaithful. Not only can this destroy a relationship but it can also be unhealthy, causing anxiety and depression. The web being a public place, may not be the best place to be advertising personal information such as phone number, email address, or even photos. In other words people with bad thoughts, ideas, or moods can transmit them to other people without ever having any face to face contact with the person. So basically if you have been following someone on one of these social networks and every time you are logged on, that certain someone is just posting negative comments and ideas, chances are that the very person reading this over and over again will begin to adapt these negative thoughts and ideas and then reflect a negative mood towards other people in their own real life, and the people they love. Which ultimately begin to take a toll on a relationship, because if one person is constantly upset the other is going to look at themselves first and feel like they are not wanted anymore. Even though social networking web sites might seem like the most amazing gift of technology, its adverse impact can ruin your strongest relationship and at the end leave you with countless regrets. Online friends, self-centered attention-seeking, short attention spans, distraction, and loss of privacy are what these social networks web sites engage you in, and not having control of it can have a negative impact on you and on your relationships. I think it was my mother who taught me the meaning of honesty. Not because she was honest, but because she lied all the time. She felt that the easiest way out of any given situation was generally the best way out. And, for her, that generally meant telling a "little white lie." As a young child I thought it was kind of cool. And, naturally, when I would come to her with a concern or question wondering what I should do, she generally advised me to lie. "Mom, I told Theresa that I would go over to her house, but now I would rather go to Sue's house to play." "Tell Theresa you're sick," she would advise. And generally I did. But I didn't seem blessed with her lack of conscience. On many painful occasions Theresa would find out that I really went to Sue's house without her. These occasions taught me that it is more painful to be caught in a lie than it is to tell the truth in the first place. I wondered how it was possible that my mother had never learned that lesson. I started thinking of all the lies that I'd heard her tell. I remembered the time she told someone that her favorite restaurant had closed, because she didn't want to see her there anymore. Or the time she told Dad that she loved the lawn mower he gave her for her birthday. Or when she claimed that our phone lines had been down when she was trying to explain why she hadn't been in touch with a friend of hers for weeks. And what bothered me even more were all the times she had incorporated me into her lies. Like the time she told my guidance counselor that I had to miss school for exploratory surgery, when she really needed me to babysit. And it even started to bother me when someone would call for her and she would ask me to tell her that she wasn't there. So, I started my own personal fight against her dishonesty. When I answered the phone and it was someone my mother didn't want to talk to, I said, "Louise, mom is here, but she doesn't want to talk to you. Its robust performance in the US and Russia is driving its growth. The second half of the fiscal is likely to be better for the company than the first one ââ¬âcharacterised by more product launches and increase in market share. It's probably the right time for investors to consider this stock. BUSINESS The company is engaged in generics, bulk drugs & custom services and proprietary products. The genericsbusiness contributes over 70% to its total revenues, which stood at $1. 7 billion in FY11. DRL has focussed on four key regions ââ¬â North America, India, Russia/CIS and Europe ââ¬â with an objective to achieve critical mass in the base business. North America is the company's largest and strongest market, contributing onethird of the company's revenues. New product launches, limited competition products and improved market share has helped the company post a strong performance in the region. DRL's German business remains its sore point, pulling down the growth rates for the European region. The pricing pressure brought about by the tender-based business structure has adversely affected its profitability. The Indian business has been a laggard since the last several quarters, but the sequential improvement in its performance in the September quarter is encouraging. Its biosimilars portfolio has done very well and has logged a growth of 22% y-o-y, hinting at a better period in the coming months. The Russian business, though not a large contributor, has proved to be yet another growth driver for the company. The OTC business, in particular, is doing well in the region. GROWTH DRIVERS DRL has targeted revenues of $3 billion and a RoCE of 25% in FY13. The company has a strong pipeline with 76 pending ANDAs (17 tentative approvals). It has 40 Para IV filings of which 11 have first to file opportunities. The company is focussing on scaling up manufacturing and having a higher mix of US generics in total global generics. In Germany, the company has undertaken cost control measures, and has commenced supplies to AOK tenders and launched new products outside the scope of tenders. Its effect would be visible from the current quarter. DRL has a tie-up with GSK to develop and market select products across emerging markets outside India. FINANCIALS While its earnings have been erratic over the years, the company's revenues have grown at a CAGR of around 21% over the last decade. DRL has restructured operations at its German and Mexican units. It has capped risky and expensive R by pulling out research in therapies like diabetes and cardiovascular. Instead, it is now channelising its R efforts towards development of limited competition products, biosimilars and new chemical entities in areas like pain management, anti-infectives and dermatology. CONCERNS Forging growth in its Indian business and profitability in its European operations is a major concern for the company. Its future growth depends on the success of its efforts in these areas. The company has raised `1,077-crore debt in the current quarter to meet working capital requirements and also to refinance old loans. This brings its total debt to over `4,200 crore. VALUATIONS The company's stock is trading at 23 times its consolidated annual earnings. These valuations are lower than its better-performing peers like Sun Pharma and Cipla. Pharma cos with huge FCCBs may not get hit as their export earnings remaining high Sanjay Pingle, Mumbai Monday, December 19, 2011, 08:00 Hrs [IST] Steady depreciation of Rupee against US Dollar and Euro may not have any major impact on Indian pharmaceutical industry despite many pharma companies have huge exposure to foreign currency loans and bonds. To a great extend, such adverse rates will be offset by the sizable export earnings of Indian pharma companies. Continuous depreciation of Indian Rupee against US Dollar and Euro is a great concern for Indian manufacturers having Foreign Currency Loans (FCLs) and Foreign Currency Convertible Bonds (FCCBs). But the exports of these companies are likely to shoot up in 2011-12 with depreciation of rupee in terms of foreign currencies. Indian pharma companies have recorded export earnings of more than 50 per cent of their revenues to US and Europe during 2010-11 and with depreciation of Rupee export earnings are likely to go up significantly. This will reduce the adverse effect on bottom line likely with the current unfavorable foreign exchange rates. Uncertainty in Euro region and recessionary conditions worldwide is making Dollar more firm against several currencies. At present, the exchange rate of Indian Rupee against dollar is moving near to Rs. 55 and that of Euro is moving over Rs. 71 as against Rs. 45. 87 per Dollar and Rs. 61. 13 per Euro year ago. The Dollar appreciated nearly by 20 per cent and Euro by almost 17 per cent within one year making FCL and Foreign Currency Convertible Bonds (FCCBs) payments costlier for Indian companies. The pharma industry has already incurred huge foreign currency loss during the first half of 2011-12 and these are likely to increase in the remaining part of the FY'12 with adverse exchange fluctuations. Though the Indian pharmaceutical companies have created strong networth position in the past, the volatile and adverse change in foreign exchange rates may put pressure on bottom line. The borrowings of Pharmabiz sample of leading 35 companies shows that the total borrowings, including secured and non-secured loan went up by 18. 3 per cent to Rs. 37,709 crore during 2010-11 from Rs. 1,899 crore in the previous year. The secured loans, including foreign currency loans and FCCBs, of 35 companies increased by 19. 8 per cent to Rs. 21,899 crore from Rs. 18,278 crore. As against these borrowings, the net worth, equity capital plus reserves & surplus, of these companies stood at Rs. 68,201 crore as compared toRs. 48,811 crore in the previous year, representing a strong growth of 39. 7 per cent in 2010-11. Out of 35 companies, 23 companies availed FCL or issued FCCBs and the aggregate amount worked out to Rs. 9,560 crore in 2010-11 as compared to Rs. 10,765 crore. Thus, FCL and FCCBs comprised of 25 per cent in 2010-11 of aggregate borrowings as compared to 34 per cent in the last year. The reduction is mainly due to redemption of FCCBs by few companies and repayment of costly FCLs. The aggregate amount of FCCBs issued by these companies reduced by 12 per cent to Rs. 5,382 crore from Rs. 6,118 crore and foreign currency loans by 10. 1 per cent to Rs. 4,178 crore from Rs. 4,647 crore. Ranbaxy Laboratories has outstanding FCCBs aggregating to US$ 440 million as at the end of December 2010. The company has shown Rs. 1,967 crore as unsecured loan for FCCBs as compared to Rs. ,048 crore in the previous year. Orchid Chemicals and Pharmaceuticals has outstanding FCCBs of Rs. 523. 58 crore as against Rs. 607. 74 crore in the 2009-10. Jubilant Lifesciences has reduced its FCCBs amount to Rs. 633. 70 crore from Rs. 861 crore in the previous year. Further, Strides Arcolab has reduced its FCCBs loan to Rs. 457. 28 crore from Rs. 634. 15 crore and Aurobind o Pharma toRs. 620. 76 crore from Rs. 767. 71 crore.
